This work analyses private antitrust damage actions in a transnational context. The analysis focuses in the determination of the competent tribunals and the practical difficulties that can be faced by follow on claims derived from decisions of the European Commission. The jurisdiction rules set for tort claims in article 7.2. Regulation 1215/2012 present interpretation problems in this kind of actions. The Decision of the EUJ CDC Hydrogen Peroxide solves in our opinion only part of the existing doubts. This work concludes with an additional proposal based on the criteria established in article 6.3.b Regulation Rome II that allow to apply the law of the directly and substantially affected market.
